Dealing with the Traffic Violations Bureau (TVB)

A traffic ticket violation in New York City has its own process, and it's extremely helpful to have a lawyer well-versed in that process. The Traffic Violations Bureau (TVB) handles all non-criminal allegations, and its procedures are different than those conducted by the broader Department of Motor Vehicles (DMV), or by the criminal court system. 

The most notable distinction is this-a TVB hearing is a winner-take-all system. There is no ability to plea bargain, where a defendant might agree to plead guilty to a lesser charge. You either beat the ticket, or you take all the consequences that come with it. That means you need an attorney who plays to win and understands what it takes to do that in the TVB. 

A TVB hearing also has different rules of evidence. The simplest way to put it is that the standards on what can be admitted as testimony are laxer than in the DMV overall or in criminal court. 

Finally, as a civil case, law enforcement is not required to prove its case “beyond a reasonable doubt,” as they would be in criminal court. The legal standard to get a guilty verdict is the lower threshold of “clear and convincing evidence.” Another way of understanding this might be that, while in criminal court, a jury must be 95% sure of themselves before ruling guilty, a TVB judge only needs about 70% certitude.
